Mediations, primarily in the form of settlement conferences, are an integral part of Montana litigation practice because federal and state district courts require mediation prior to setting a date for the trial. These confidential proceedings are governed by statute and court rules, offer an alternate form of dispute resolution and allow for an independent evaluation of a case by experienced counsel.
